Agreement to terms

By accessing or using InkDay ("the App"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the App.

InkDay is a personal journaling application designed to help you reflect through daily questions. The App is provided by InkDay ("we," "us," or "our").

Use of the app

License

We grant you a limited, non-exclusive, non-transferable, revocable license to use InkDay for personal, non-commercial purposes in accordance with these Terms.

Acceptable use

You agree to use the App only for lawful purposes. You may not:

  • Reverse engineer, decompile, or disassemble the App
  • Use the App to violate any applicable laws or regulations
  • Attempt to gain unauthorized access to any part of the App
  • Remove or modify any copyright or proprietary notices
  • Use the App in any way that could damage or impair our services

Your content and data

Ownership: You retain all rights to your journal entries and reflections. Your content is yours, and it stays on your device.

No access: We do not have access to your journal entries. Because the App works entirely offline and stores data locally on your device, we cannot view, access, or retrieve your content.

Responsibility: You are responsible for maintaining backups of your data through your device's backup features (such as iCloud backup). We are not responsible for any loss of data.

Intellectual property

The App, including its design, features, reflection questions, and all content provided by us, is protected by copyright, trademark, and other intellectual property laws.

InkDay, the InkDay logo, and all related marks are trademarks of InkDay. You may not use these marks without our prior written permission.

Subscriptions and payments

InkDay may offer paid features or subscriptions through the Apple App Store. If you purchase a subscription:

  • Payment will be charged to your Apple ID account at confirmation of purchase
  • Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
  • You can manage or cancel your subscription in your App Store account settings
  • Refunds are handled according to Apple's refund policies

Disclaimers

As-is basis: The App is provided "as is" and "as available" without warranties of any kind, either express or implied.

Not medical advice: InkDay is a journaling tool for personal reflection and self-awareness. It is not intended to be a substitute for professional mental health care, therapy, or medical advice. If you are experiencing mental health issues, please consult a qualified healthcare professional.

No guarantees: While we design reflection questions based on behavioral science principles, we do not guarantee specific outcomes or results from using the App.

Limitation of liability

To the maximum extent permitted by law, InkDay and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, or other intangible losses resulting from your use of the App.

Changes to the app and terms

We reserve the right to modify, suspend, or discontinue the App at any time. We may also update these Terms from time to time. Material changes will be communicated through the App or our website.

Continued use of the App after changes to these Terms constitutes acceptance of the updated Terms.

Termination

You may stop using the App at any time by deleting it from your device. We reserve the right to terminate or suspend your access to the App if you violate these Terms, though given the App's offline nature, this would primarily apply to future updates or services.

Governing law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which InkDay operates, without regard to conflict of law principles.

Apple App Store requirements

If you downloaded InkDay from the Apple App Store, you acknowledge that:

  • These Terms are between you and InkDay, not Apple
  • Apple has no obligation to provide maintenance or support for the App
  • Apple is not responsible for any product liability claims, third-party intellectual property infringement claims, or claims that the App fails to conform to applicable legal requirements
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them
